The occasional rental agreement signing: digital pre-signing and final hand-written signing with a notarised statement

1. Agreement (with general terms) signing digitally

The first pre-signing is digital via Autenti. The landlord and tenant will get instructions with the e-mail.

  • Please note that at this stage, agreement only has the power of a regular agreement – before remaining formalities are concluded, Rendin protection applies as if you signed a regular agreement.

1.1. Additional documentation

After digital signing both parties receive two templates to their e-mail. It's meant for the tenant to print it, fill it out and take it to the notary.

  • Address indication of where the tenant moves in case of eviction.
  • Statement of the premises owner (or person with a legal title to the premises) with their consent to the tenant and co-tenant(s) living in the address indicated in the declaration.

 

2. Agreement signing on paper

The second stage is final signing. You need to print the agreement in two copies, and both parties must sign it by hand. A hand-signed agreement must be presented to the notary.

 

3. Notarial deed

Based on the hand-signed agreement and other paperwork (1.1.) the notary creates a statement – submission to voluntary eviction – that tenant needs to sign. It is an essential appendix to the agreement.

The notarial deed is crucial and obligatory to make the agreement status of occasional rental agreements. Also, it helps us provide the best legal framework to operate in and will enable us to support and protect our clients in the best way to solve their issues. For example, in case of legal assistance in tenant eviction and bailiff proceedings.

 

4. Notification to the tax office

The agreement, including the notary signed statement, will remain valid if the landlord informs the tax office about the agreement within 14 days after the agreement takes effect. If the landlord skips this part, our legal department can't help the landlord with the eviction process.

  • We send the suitable document template that needs to be submitted to the tax office to the landlord via e-mail.

 

What else to know?

  • Both parties can book the appointment with the notary. The tenant must be present. Landlord’s presence is optional, yet we recommend they be on the spot as well.
  • The deed’s cost is around 400-600 złoty. We advise the landlord to pay it, but the parties can agree on it themselves.
